Terms & Conditions

1. General Provisions

These Terms and Conditions set out the rules of cooperation between ijsound studio, with its registered office at ul. Władysława Taklińskiego 12, 30-499 Kraków, Poland (hereinafter the "Contractor"), and clients ordering design, supply, installation and service of audiovisual (AV) systems, telecommunications networks, video surveillance and Smart Office solutions (hereinafter the "Services").

Submitting a request for quotation, accepting a quote, or signing a contract/order is deemed equivalent to acceptance of these Terms and Conditions, unless the parties agree otherwise in a separate written contract.

2. Quotes and Estimates

• Quotes prepared on the basis of an initial project description are estimates and may change following an on-site survey or a more precise definition of the scope of work.
• A binding offer specifies the scope of supplies, installation work, schedule and remuneration, and is confirmed separately for each project.
• Changes to the scope reported during execution (so-called additional work) require a separate quote and the acceptance of both parties before being carried out.

3. Performance of Installation Services

Installation and configuration work is performed by technicians holding the appropriate qualifications, including — where the scope of work requires it — SEP electrical qualifications (up to 1 kV) for the operation and supervision of power equipment, valid under Polish law. Structured cabling installations are carried out in accordance with the PN-EN 50173 standard and the guidelines of the manufacturers of the cabling systems used.

The Client is obliged to provide the Contractor with access to the site where the work is to be carried out and — if required under the Polish Construction Law or the building's rules — the necessary consents of the property owner/manager for installation work, including drilling, mounting and cable routing.

Acceptance of the work is documented in a handover protocol following completion of the installation and successful functional testing of the system.

4. Guarantee and Statutory Warranty (Rękojmia)

The Contractor is liable for the quality of the work performed under the statutory warranty (rękojmia) rules set out in the Polish Civil Code, to the extent the parties have not agreed otherwise in a business-to-business (B2B) contract, where the statutory warranty may be limited or modified in accordance with Article 558 § 1 of the Polish Civil Code.

• For completed installation work (cabling, assembly, configuration), the Contractor provides a guarantee for a period of 24 months from the date of the handover protocol, unless otherwise agreed in the contract.
• Equipment and devices supplied as part of the project are covered by the manufacturer's warranty for that equipment — the period and terms are set out in the manufacturer's warranty card.
• The guarantee does not cover damage resulting from improper use, unauthorized interference with the system by unauthorized persons, random events (e.g. power surges, flooding) or normal wear and tear.

5. Reporting Faults and Complaints

Faults should be reported electronically to kontakt@ijsoundstudio.pl or by phone, with a description of the problem and, where possible, photographic documentation. The Contractor undertakes to confirm receipt of the report within 2 business days and to propose a date for a service visit.

Clients who are consumers within the meaning of the Polish Civil Code are entitled to the rights arising from the Act on Consumer Rights, which these Terms and Conditions do not limit.

6. Liability of the Parties

The Contractor shall not be liable for failures or malfunctions of the system resulting from: interruptions in the Client's power or internet supply, changes to the network infrastructure made by third parties without the Contractor's knowledge, or force majeure.

The Contractor's liability for damages arising from non-performance or improper performance of the contract is limited to the net remuneration agreed for the given project, unless the damage was caused intentionally.

7. Copyright in Designs

Technical designs, visualization concepts and documentation prepared by the Contractor at the offer stage constitute its intellectual property and may not be used or disclosed to third parties without the Contractor's consent until a contract is concluded and remuneration is settled.

8. Personal Data Protection (GDPR)

In accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), we inform you that:

• The data controller is ijsound studio, ul. Władysława Taklińskiego 12, 30-499 Kraków, NIP: 6793166424, Poland, email: kontakt@ijsoundstudio.pl.
• Personal data provided via the contact form, quote request form, or during the performance of a contract, is processed in order to respond to inquiries, prepare offers and — in the event a contract is concluded — to perform and settle it (legal basis: Article 6(1)(b) and (f) GDPR).
• Data is stored for the period necessary to achieve the purpose of processing, and in the case of data related to a concluded contract — for the period required by tax and accounting regulations (as a rule, 5 years from the end of the year in which the contract expired).
• The data subject has the right to access their data, rectify it, erase it, restrict its processing, transfer it, and object to its processing, as well as the right to lodge a complaint with the President of the Polish Data Protection Authority (UODO).
• Providing the data is voluntary but necessary to handle the inquiry or perform the contract.
• Data is not transferred to third countries or used for automated decision-making, including profiling.

9. Final Provisions

In matters not regulated by these Terms and Conditions, the provisions of the Polish Civil Code and other relevant Polish laws shall apply. The parties will endeavor to resolve any disputes amicably, and in the absence of agreement, the competent court shall be determined in accordance with general provisions.
